Failure to Substantiate Appeal Renders Federal Supreme Court Review Inapplicable
Legislator-Zusammenfassung
KI-generiertThe case involves an individual who filed a complaint against a state prosecutor's office after the appellate court of a specific canton chose not to proceed with the complaint, citing inadequate justification on the part of the complainant. The complainant did not address the specific requirements for justification of a cantonal complaint in their submission to the Federal Tribunal, leading to the dismissal of their appeal. The court determined that the appeal did not meet the necessary legal criteria for consideration and opted not to impose any costs related to the case.

Urteil vom 20. Dezember 2008
Strafrechtliche Abteilung
Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.
Parteien
X.________,
Beschwerdeführer,
gegen
Staatsanwaltschaft des Kantons Basel-Stadt, Binningerstrasse 21, Postfach, 4001 Basel,
Beschwerdegegnerin.
Gegenstand
