Cantonal Refusal to Review Custodial Measure Upheld on Procedural Grounds
Legislator-Zusammenfassung
KI-generiertA person filed a complaint concerning the continuation of a stationary measure under criminal law, following a prior decision by a cantonal administrative court that dismissed the complaint due to inadequate justification and lack of a clear request. In the Swiss Federal Tribunal, the individual sought compensation of 90,000 euros, claiming to have been tortured by the police. However, the court found that there was no evidence supporting the allegations and that the complaint did not meet the legal requirements for consideration. The tribunal therefore decided not to engage with the appeal and opted to not impose any court costs.

KI-generiertThe required compliance with formal submission requirements (mentioned in the consideration) is linked to this article regarding inadmissibility.
The appeal was not entered upon based on the procedural rule articulated here.
The submission failed to meet the formal requirements of this article.
Although no explicit request for legal aid was noted in the reasoning, the following point 2 states that the charging of costs is waived, which implicitly handles the costs aspect, but the operative part (point 2) only mentions cost elevation waiver, not Article 64 LTF.
Although the court waived the imposition of costs, there is no explicit citation of Art. 66 al. 1 LTF in the operative part (point 2).
The reasoning states that the appeal does not show a violation of Swiss law in the sense of this article, which is a ground for review.

Urteil vom 1. November 2010
Strafrechtliche Abteilung
Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber C. Monn.
Verfahrensbeteiligte
X.________,
Beschwerdeführer,
gegen
Amt für Justizvollzug des Kantons Zürich, Amtsleitung, Feldstrasse 42, 8090 Zürich Amtsstellen Kt ZH,
Beschwerdegegner.
Gegenstand
Stationäre Massnahme nach Art. 59 StGB ,
Beschwerde gegen die Verfügung des Verwaltungsgerichts des Kantons Zürich, 3. Abteilung, vom 8. September 2010.
Der Präsident zieht in Erwägung:
Abteilung, schriftlich mitgeteilt.
