Federal Supreme Court Dismisses Recourse Against Annulment of Prescription Finding
Legislator-Zusammenfassung
KI-generiertThe case involves a legal dispute concerning the prescription of penalties imposed on an individual for offenses under a specific law. Initially, a lower court determined that the penalties of two and a half years of imprisonment and a seven-year expulsion had been prescribed and dismissed the individual's subsequent relief request. The public prosecutor appealed this decision, leading to a higher court reversing the lower court's ruling and remanding the case. The individual then appealed to the Federal Tribunal, seeking to uphold the initial ruling or, alternatively, to annul the higher court's decision. However, the Tribunal deemed the appeal inadmissible, as the contested ruling did not cause irreparable harm or open a long and costly evidentiary procedure.

KI-generiertUsed as the specific procedural ground to declare the appeal inadmissible because it concerned an interlocutory decision causing no irreparable harm.
Applied in the second order to impose the judicial costs on the appellant who lost the case.
Cited in the reasoning as a condition under which an interlocutory decision can be appealed, which is relevant context for the final finding of inadmissibility.

contre
