Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court struck the case from the roll and ordered no court costs, as the appellants withdrew their appeal. The appellants had sought to overturn a judgment of the Cantonal Criminal Court of Ticino concerning confiscation, filing both a criminal-law appeal and a subsidiary constitutional appeal. The withdrawal was accepted, and the case was dismissed as moot pursuant to Article 32(1)-(2) LTF, with the court exercising its discretion under Article 66(2) LTF to waive judicial fees. The prior cantonal judgment remains in force.

Oggetto

Confisca,

ricorso in materia penale e ricorso sussidiario in

materia costituzionale contro la sentenza emanata

il 18 giugno 2010 dalla Corte delle assise criminali

del Cantone Ticino.

Considerando:

che con ricorso in materia penale e ricorso sussidiario in materia costituzionale del 14 settembre 2010 A.________ e B.________ hanno impugnato dinanzi al Tribunale federale la sentenza emanata il 18 giugno 2010 dalla Corte delle assise criminali del Cantone Ticino, postulandone l'annullamento;

che con lettera del 23 agosto 2011 A.________ e B.________ hanno comunicato al Tribunale federale di ritirare il loro gravame;

che il presidente o il giudice dell'istruzione della Corte decide quale giudice unico circa lo stralcio dal ruolo delle cause ritirate ( art. 32 cpv. 1 e 2 LTF ) e, in tale ambito, statuisce sulle spese giudiziarie ( art. 5 cpv. 2 PC in relazione con l' art. 71 LTF );

che, in caso di desistenza, il Tribunale federale può rinunciare in tutto o in parte a riscuotere le spese giudiziarie ( art. 66 cpv. 2 LTF );

che nella fattispecie si può rinunciare a prelevare spese processuali;

per questi motivi, il Giudice unico decreta:
