Embezzlement, forgery, and attempted fraud conviction; appeal dismissed as untimely under Art. 100(1) BGG due to missed filing deadline after judicial holiday suspension.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declined to enter the appeal and upheld the prior instance’s decision, dismissing the appellant’s challenge as untimely. The appellant had been convicted of embezzlement, multiple counts of forgery, and multiple counts of attempted fraud, and had appealed the sentencing decision of the Cantonal Court of Fribourg. The Supreme Court found that the appeal was filed after the statutory deadline: the challenged decision was served on 23 July 2008, and the appeal period, extended by the judicial holidays, expired on 15 September 2008, whereas the appellant submitted the appeal to the post on 22 September 2008. Relying on Article 100(1) and Article 46(1)(b) of the Federal Supreme Court Act (BGG), the Court held the appeal was late, ordered no entry into the merits, and imposed court costs of CHF 800 on the appellant.
