Legislator-Zusammenfassung

In this case, a complaint was filed by an individual against another individual for insults and threats. The local Chamber of Accusation annulled the initial decision to dismiss the complaint and ordered the public prosecutor to investigate certain aspects of the allegations. The individual accused subsequently appealed this decision to the Federal Tribunal, seeking its annulment. The Federal Tribunal ultimately considered the appeal to be inadmissible, as the decision in question was deemed incidental and did not pose an irreparable disadvantage to the appellant, nor did it end the legal proceedings.

Art. 108 al. 1 let. a LTF

Used by the President to declare the appeal inadmissible via simplified procedure.

Art. 66 al. 1 LTF

Used to order the unsuccessful appellant to bear the court costs.

Art. 93 al. 1 LTF

Cited in the reasoning (Considerant 2) to explain why an appeal against an interlocutory decision generally does not lead to recourse, though the final order specifies inadmissibility primarily under Art. 108 LTF.
