Driving Despite License Revocation: Appeal Inadmissible for Lack of Formal Request and Insufficient Legal Reasoning Under Article 42 BGG
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (Criminal Law Division) dismissed the appellant's appeal and did not enter into the merits, upholding the lower court's decision. The appellant had been convicted of multiple counts of driving a motor vehicle despite having his driver's license revoked, and the appeal challenged the cantonal appellate court's ruling. The Court held that the appeal failed to meet the formal requirements of Article 42(1) and (2) of the Federal Supreme Court Act (BGG), because the appellant's submission contained neither a formal request nor adequate legal reasoning, and instead merely explained personal circumstances and why he had not attended the appellate hearing. Consequently, the Court ordered the appellant to pay court costs of CHF 800.
