Untimely criminal-law appeal to the Federal Supreme Court filed one day after the 30-day deadline under Article 100(1) LTF, with unsuccessful postal delivery from abroad.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declared the appellant's criminal-law appeal inadmissible as untimely and ordered the appellant to pay court costs of 800 francs, thereby affirming the prior appellate judgment. The appellant had challenged a decision of the Vaud Cantonal Court’s Criminal Appeals Chamber (dated 7 March 2016). The appeal was filed out of time: the contested judgment was notified on 10 May 2016, making the 30-day filing deadline (Article 100(1) LTF) expire on 9 June 2016, but the appellant posted the appeal from France on 10 June 2016, arriving at Swiss Post on 11 June 2016—one day late. Under Article 48(1) LTF, a timely filing requires submission to Swiss Post or a Swiss diplomatic/consular mission by the final day of the deadline; the appeal was therefore dismissed under Article 108(1)(a) LTF.

Considérant en fait et en droit :
