In this case, an individual appealed to a higher court after being denied satisfaction by the lower court regarding a complaint of criminal behavior related to breaches of civil law involving two other parties. The initial ruling stated that the matter did not fall under criminal jurisdiction, as the dispute was deemed a violation of civil rights rather than a criminal offense. The appellant argued that they had not received appropriate compensation from the other parties involved, but failed to demonstrate that the lower court's reasoning was erroneous, leading to the higher court's decision to deem the appeal inadmissible. Additionally, the request for legal aid in this situation was also rejected due to the unfavorable outcome of the appeal.

Art. 108 al. 1 let. b LTF

This provision, mentioned in the reasoning, would typically be relevant for inadmissibility based on lack of proper motivation, but is not explicitly cited in the final dispositive orders concerning the decision itself (only Art. 93 LTF is the usual ground for inadmissibility in the dispositive, though here the court chose not to cite a specific admissibility article in order 1).

Art. 64 al. 1 LTF

Cited in the dispositive when rejecting the request for legal aid because the appeal was doomed to fail.

Art. 66 al. 1 LTF

Cited in the dispositive to impose court costs on the appellant.

Arrêt du 4 septembre 2013

Cour de droit pénal

Composition

M. le Juge fédéral Schneider, Juge unique.

X.________,

recourant,

contre
