Federal Tribunal Inadmissibility Ruling on Factual Challenge to Discontinuance of Bodily Harm and Rape Charges
Legislator-Zusammenfassung
KI-generiertIn this case, a complaint was made concerning alleged bodily injuries, assaults, and rape against an individual. The local investigative judge issued a decision of non-prosecution, which was subsequently upheld by the cantonal Court of Accusation. The complainant then appealed to the federal tribunal, seeking the annulment of the prior ruling and requesting that the accused be prosecuted for the reported incidents. However, the federal tribunal determined that the appeal was inadmissible as it primarily challenged factual determinations rather than the application of federal criminal law. Consequently, the complainant was ordered to cover the legal costs associated with the proceedings.

KI-generiertCited in the reasoning but not in the dispositive. The dispositive only ruled on inadmissibility without citing a specific provision for it, likely implicitly referencing Art. 93 LTF or similar for inadmissibility, but Art. 108 LTF was cited only in reference to the obligation to motivate the appeal.
Applied in the dispositive to impose court costs on the unsuccessful appellant.

Objet
