Complainant's Standing to Appeal Acquittal in Fraud Case
Legislator-Zusammenfassung
KI-generiertIn this case, an individual filed a criminal complaint for fraud, which led to the issuance of a non-prosecution order by the authorities. The individual appealed the decision of the Cantonal Tribunal, which had confirmed the non-prosecution. However, the appeal was deemed inadmissible by the Federal Tribunal because the individual did not meet the criteria to be considered a victim under the applicable legal provisions, and therefore lacked the standing to challenge the decision of the prosecutorial authorities. Consequently, the appeal was rejected, and the appellant was ordered to bear the legal costs.
