Legislator-Zusammenfassung

KI-generiert

The case involves an individual who was accused of violating environmental protection laws and causing minor property damage. The individual filed complaints against decisions made by a regional court but failed to substantiate claims of legal violations in those decisions. Despite a request for a cost deposit for consideration of the complaints, the individual submitted a document asking the court to cease further engagement in the matter, without explicitly withdrawing the complaints. Ultimately, the court determined it would not proceed with the complaints due to insufficient legal grounds and chose not to impose any costs on the individual.

Art. 95 BGG
The provision was cited to establish that the appeal submissions did not show how the contested decisions violated this legal standard.
Art. 106 Abs. 2 BGG
The provision was cited noting that the appeal submissions failed to meet the justification requirements under this article.
Art. 108 BGG
The appeal was declared inadmissible without entering into its merits based on this procedural provision.
Art. 42 Abs. 2 BGG
The provision was cited noting that the appeal submissions failed to meet the justification requirements under this article.
Art. 66 al. 1 LTF
Although not explicitly listed in the final orders, the procedural decision to not levy costs (Art. 2 in the dispositive) is based on the general cost provisions, but since the text explicitly mentions 'Es werden keine Kosten erhoben' (no costs levied), we check for the legal basis for cost imposition/exemption. The dispositive explicitly orders 'Es werden keine Kosten erhoben.' While Art. 66 LTF generally governs costs, the exemption is implicitly covered by the reference context, however, since no specific article regarding cost exemption is cited in the dispositive, only the explicit cost waiver order is present. We check the reasoning where it states: 'Ausnahmsweise kann auf eine Kostenauflage verzichtet werden' but doesn't cite the legal basis for that exemption explicitly in the dispositive. Since the dispositive only contains Art. 1 and Art. 2, and Art. 2 only states 'Keine Kosten', and no cost-related article (like Art. 66) is explicitly mentioned in the numbered orders, we stick strictly to the output rule.

Urteil vom 17. September 2009

Strafrechtliche Abteilung

Besetzung

Bundesrichter Favre, Präsident,

Gerichtsschreiber Monn.

Parteien

X.________,

Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, 5001 Aarau,

Beschwerdegegnerin.

Gegenstand

Widerhandlung gegen das Gewässerschutzgesetz, geringfügige Sachbeschädigung,

Beschwerden gegen die Urteile des Obergerichts des Kantons Aargau, Strafgericht, 2. Kammer, vom 15. April und 15. Juni 2009 (SST.2008.162/SS/wm und SST.2009.84/ch/nl).

Der Präsident zieht in Erwägung:

2. Ausnahmsweise kann auf eine Kostenauflage verzichtet werden.

Demnach erkennt der Präsident:

1. Auf die Beschwerden wird nicht eingetreten.

2. Es werden keine Kosten erhoben.

3. Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Strafgericht, 2. Kammer, schriftlich mitgeteilt.

Lausanne, 17. September 2009
