Complainant Fails to Substantiate Appeal Against Refusal to Hear Case Due to Unpaid Fee
Legislator-Zusammenfassung
KI-generiertIn this case, an individual submitted a criminal complaint to the investigative office in St. Gallen, which was not accepted for further action on January 29, 2013. The individual then appealed this decision, but the St. Gallen prosecution chamber dismissed the appeal on May 14, 2013, due to the failure to pay a required deposit of 1,000 francs. The individual argued financial inability to pay the fee but did not demonstrate how the prior decision was unlawful or unconstitutional, leading to the rejection of the appeal by the federal court for lack of substantiation.

The appeal was not admitted based on this procedural provision because it did not meet the requirements.
Cited in the reasoning as a requirement for the appeal's substantiation, which was not met.
Although not explicitly cited in the dispositive, the decision to waive costs (Art. 2) implies the application of cost rules, but since the dispositive explicitly states 'Es werden keine Kosten erhoben' without citing a specific cost article for that order, and the only cost-related article mentioned in the reasoning is Art. 66 al. 1 LTF (which is not in the dispositive), I must strictly adhere to the rule: only include provisions explicitly cited in the dispositive. Since the dispositive only contains orders 1, 2, and 3, and only order 2 ('Es werden keine Kosten erhoben') relates to costs without citing a specific article, I will only include the procedural/substantive articles cited in the reasoning that led to the non-admission (Art. 108 BGG) and the cited admissibility requirements (Art. 42/106 BGG), as these were the basis for the ruling in order 1.

Urteil vom 3. Juni 2013
Strafrechtliche Abteilung
Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiberin Arquint Hill.
Verfahrensbeteiligte
X.________,
Beschwerdeführerin,
gegen
Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
Beschwerdegegnerin.
Gegenstand
Nichtanhandnahme,
