Lack of Standing and Formal Requirements in Criminal Complaint Appeal
Legislator-Zusammenfassung
KI-generiertIn this case, the Swiss Federal Tribunal examined a complaint regarding the non-admissibility of a criminal complaint filed against unknown parties, presumably involving insurance companies and state offices, for alleged offenses including arson, construction defects, and pollution of water sources. The complaint was rejected by the public prosecutor's office, leading to an appeal that was ultimately dismissed by the tribunal. The complainant lacked standing to file the complaint and failed to meet the necessary procedural requirements, including a specific request and justification related to the contested decision. Consequently, the tribunal ruled that it was not authorized to proceed with the administrative investigation sought by the complainant.

Urteil vom 7. September 2007
Strafrechtliche Abteilung
Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.
Parteien
X.________,
Beschwerdeführer,
gegen
Staatsanwaltschaft des Kantons St. Gallen, Spisergasse 15, 9001 St. Gallen.
Gegenstand
