Fine Conversion to Custodial Sentence Upheld Over Welfare Payment Objections
Legislator-Zusammenfassung
KI-generiertThe case involves an individual contesting the conversion of a fine of 250 CHF into an eight-day imprisonment, as mandated by a lower court. The individual argued that financial difficulties prevented him from paying the fine, although he did not sufficiently address the possibility of paying in installments as suggested by the court. Ultimately, the higher court decided not to entertain the appeal due to a lack of substantive evidence supporting a reconsideration of the case, although it acknowledged the individual's challenging financial circumstances and waived any associated costs for the proceedings.

KI-generiertUsed to rule that the appeal shall not be entertained using the simplified procedure.
Although not explicitly cited with the number '66 al. 1 BGG' in the dispositive, the second point of the dispositive ('Es werden keine Kosten erhoben.') implies the application of the relevant cost provision, which is typically Art. 66 LTF (BGG). However, strictly following the rule 'Include a provision **only if it is explicitly cited in the dispositive**', and noting that the dispositive only states 'Es werden keine Kosten erhoben.' without citing *Art. 66 BGG*, this provision must be excluded based on the strict extraction rule.
Cited incidentally in the reasoning regarding the standard of review for factual findings, but not explicitly in the dispositive orders 1, 2, or 3, thus excluded based on strict instruction (However, the instruction states to only include provisions explicitly cited in the final orders). Since the disposition only mentions non-admission, costs, and notification, and Art. 108 BGG covers the non-admission, Art. 97 is excluded.

Urteil vom 25. Januar 2008
Strafrechtliche Abteilung
Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.
Parteien
X.________,
Beschwerdeführer,
gegen
Staatsanwaltschaft des Kantons Schaffhausen, Herrenacker 26, 8200 Schaffhausen,
Beschwerdegegnerin.
Gegenstand
