Lack of standing to challenge refusal to open criminal investigation: alleged police abuse of authority not impairing physical or psychological integrity.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (Criminal Appeals Division) dismissed the appeal and rejected the request for free legal aid, ordering the appellant to pay a reduced court fee of CHF 500. The decision below remains in force. The appellant had sought to challenge a cantonal decision not to open criminal proceedings against a police officer for abuse of authority and related offenses. The Court held the appellant lacked standing: he was not a private prosecutor, was not a victim under the Victim Assistance Act (since the alleged conduct did not directly impair his physical or psychological integrity), and had no legally protected interest in the civil aspect of the case. The appeal was therefore inadmissible under Article 108 of the Federal Supreme Court Act, and the request for free legal aid was denied as futile.

Urteil vom 12. August 2007
Strafrechtliche Abteilung
Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.
Parteien
X.________,
Beschwerdeführer,
gegen
Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.
Gegenstand
Eröffnung einer Untersuchung gegen Behördenmitglieder und Beamte (Amtsmissbrauch etc.),
Beschwerde in Strafsachen gegen den Beschluss des Obergerichts des Kantons Zürich, II. Zivilkammer, vom 29. Juni 2007.
Der Präsident zieht in Erwägung:
4. Dieses Urteil wird dem Beschwerdeführer, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.
