The case involves a labor accident that occurred during a construction project in June 2002, which led to a criminal investigation. Following the investigation, a judge issued a ruling in March 2009 declaring a non-prosecution for one individual while proceeding with charges against four others for serious bodily harm due to negligence. The individual affected appealed this decision; however, the appellate court upheld the original ruling in April 2009. Consequently, the affected individual took the matter to the federal tribunal, seeking to annul the non-prosecution order and have it referred back to the magistrate for further action against the relevant parties.

Objet
