Legislator-Zusammenfassung

The Swiss Federal Supreme Court declared the appellant's criminal-law appeal inadmissible, thereby upholding the cantonal decisions and leaving the lower court's ruling in force. The dispute concerned the appellant's challenge to a ruling that his opposition to a penal order was time-barred; the cantonal court had applied the legal fiction of notification, deeming the penal order notified by early October 2012, making his opposition filed in October 2013 late. The Supreme Court based its decision on procedural grounds, finding the appeal failed to meet the statutory reasoning requirements under Article 42(2) of the Federal Supreme Court Act, as the appellant did not address the lower court's legal reasoning or demonstrate arbitrary factual findings under Article 97(1). The Court also rejected the request for legal aid (Article 64(1)) because the appeal had no chance of success, and ordered the appellant to pay reduced court costs of 500 Swiss francs.

Objet

Mathys Gehring
