Federal Supreme Court Dismisses Appeal on Foreign Nationals Act Due to Procedural Error
Legislator-Zusammenfassung
KI-generiertIn this case, an individual appealed to the Federal Tribunal following a decision by the Cantonal Court of Zug, which had rejected his appeal due to the failure to properly present the legal remedy as required by procedural law. The Federal Tribunal's examination was limited to the procedural aspects surrounding the appeal declaration, and the appellant's personal circumstances were deemed outside the scope of consideration. Consequently, the Federal Tribunal decided not to address the complaint, and no costs were imposed on the parties involved.

KI-generiertUsed by the President to decide not to enter upon the appeal (non-entrée en matière).
Mentioned in the reasoning as the requirement violated by the appellant, but not directly cited in the dispositive orders unless it pertains to costs or procedure that leads to the final ruling (Note: Only Art. 108 BGG dictates the ruling on non-entry in this specific context, though Art. 42 leads to the Art. 108 conclusion. Since Art. 108 mandates the non-entry, we prioritize it. Since Art. 42 is only used to justify why the requirements are not met, and the operative part only cites Art. 108 for the decision not to proceed, we focus on Art. 108 and the cost disposition).
Implied by the order not to levy any court costs (Erhebung von Gerichtskosten).

Besetzung
Bundesrichter Mathys, Präsident,

X.________,
Beschwerdeführer,
gegen
Staatsanwaltschaft des Kantons Zug, Leitender Oberstaatsanwalt , An der Aa 4, 6300 Zug,
Beschwerdegegnerin.
Gegenstand
