Refusal to Open Criminal Investigation as Non-Burdensome: Lack of Legal Standing and Insufficient Reasoning in Appeal
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declined to entertain the appellant's appeal and dismissed the case, upholding the lower court's decision to refuse to hear the appellant's earlier recourse. The dispute arose from the public prosecutor's decision not to open a criminal investigation into an incident on November 8, 2008, and to bear the costs. The Supreme Court ruled that the appellant failed to challenge, in his appeal, the lower court's finding that he lacked legal standing or grievance (Beschwer) because the prosecutor's decision and its reasoning did not burden him. The Court held that the appeal did not meet the procedural requirements for stating reasons under Articles 42(2) and 106(2) of the Federal Supreme Court Act (BGG), rendering it inadmissible. The Court ordered the appellant to pay court costs of 500 Swiss francs, with consideration given to his financial situation.

Urteil vom 24. April 2009
Strafrechtliche Abteilung
Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.
Parteien
X.________,
Beschwerdeführer,
gegen
Staatsanwaltschaft Winterthur / Unterland,
Hermann Götz-Strasse 24, 8400 Winterthur,
Beschwerdegegnerin.
Gegenstand
Einstellung der Untersuchung,
Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 24. März 2009.
Der Präsident zieht in Erwägung:
3. Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.
