Appellant Lacking Victim Standing Precludes Appeal of Inadmissibility Decision
Legislator-Zusammenfassung
KI-generiertThe case involves a complaint by an individual against several parties for allegedly violating their privacy during a psychiatric hospitalization and potential guardianship proceedings. The individual sought to appeal the decision of the Geneva Chamber of Accusation, which declared the complaint inadmissible without addressing the substantive issues. The appellant subsequently filed a criminal appeal with the Federal Tribunal, alleging that an unknown member of a social media platform had disclosed personal information about them online. The appeal was evaluated and found to be manifestly inadmissible due to the lack of standing and failure to articulate a legal basis for the claims.

KI-generiertThis article was cited in the reasoning as the basis for the President to decide not to enter into consideration of the appeal in a simplified procedure due to manifest inadmissibility.
This procedural rule governed the decision to handle the appeal in a simplified procedure.
This article was cited as the basis for deeming the appeal inadmissible due to insufficient motivation, as the appellant failed to explain how the contested decision violated the law.
Although not explicitly cited in the dispositive (1. and 2.), the rule on costs implies reference to the relevant articles governing judicial costs, which are typically Art. 65 ff. LTF. However, adhering strictly to the rule: since the dispositive explicitly states 'Il n'est pas perçu de frais judiciaires' (Order 2), and no specific cost article is listed in the orders, only the mentioned provisions (Art. 108, 81, 42, 2 LAVI) are confirmed. If explicit cost articles were cited in *Order 2*, they would be included. Since they are absent, no cost article is included based strictly on the dispositive text provided.
This article defines the standing to appeal, which was found lacking by the Tribunal in its assessment of admissibility.
This article was referenced to determine if the appellant qualified as a victim, which is a prerequisite for standing.

Arrêt du 21 mai 2008
Cour de droit pénal
Composition
M. le Juge Schneider, Président.
Greffier: M. Fink.
Parties
X.________,
recourant,
contre
