In this case, a woman involved in divorce proceedings filed a criminal complaint against a bankruptcy office following a seizure report concerning her husband, who was in arrears with maintenance payments. The investigating judge decided not to proceed with the complaint, and subsequently, the President of the Penal Chamber of the cantonal court rejected her appeal, deeming it untimely and lacking merit due to insufficient evidence of abuse of authority. The woman then appealed to the Federal Tribunal, arguing that the time frame for filing her complaint was too short and alleging favoritism by the bankruptcy official towards her husband. However, her appeal was deemed inadmissible due to a lack of adequate reasoning.

Art. 108 al. 1 let. b LTF

Used to justify the application of the simplified procedure.

Art. 42 al. 2 LTF

Cited in the reasoning regarding the insufficient motivation requirement for the appeal, though not directly in the formal orders, but is implicitly related to the inadmissibility ruling based on formal grounds.

Art. 64 LTF

Provision under which legal aid (or in this case, exemption from costs due to economic precarity) is applied, though the dispositive explicitly waives fees without citing Art. 64.

Arrêt du 2 juillet 2007

Cour de droit pénal

Composition

M. le Juge Schneider, Président.

Greffier: M. Fink.

Parties

X.________,

recourante,

contre
