Legislator-Zusammenfassung

In this case, an individual challenged a fine imposed for speeding, having previously been convicted multiple times for similar offenses. The cantonal court had upheld the fine, emphasizing that despite the individual's precarious financial situation, the penalty was justified due to the repeated nature of the violations. In the appeal to the Federal Tribunal, the individual sought a reduction of the fine, arguing that the court did not adequately consider their financial capacity as required by law. However, the Federal Tribunal found the appeal to be insufficiently justified and thus irretrievable, ultimately deciding not to impose any court fees due to the individual's financial circumstances.

Art. 108 al. 1 let. b LTF

Used by the President to decide not to enter into the merits of the appeal due to manifestly insufficient reasoning.

Art. 42 al. 2 LTF

Cited as the rule breached by the appellant regarding insufficient reasoning, justifying the decision not to enter into the merits.

Art. 64 LTF

Implicitly applied as the ground for granting the request for judicial assistance, although ultimately only costs (Art. 66 LTF is usually governing costs, but the text states judicial assistance becomes moot due to the exceptional no-cost decision, thus Art. 64 is relevant to the request aspect).

Art. 66 al. 1 LTF

Implicitly relevant as the general rule for costs, though the final order 2 rules for no court fees.

Arrêt du 17 avril 2008

Cour de droit pénal

Composition

M. le Juge Schneider, Président.

Greffier: M. Fink.

Parties

X.________,

recourant,

contre

Procureur général du canton du Jura, Le Château, 2900 Porrentruy,

intimé.

Objet
