Federal Supreme Court Dismisses Embezzlement Appeal as Untimely Due to Late Filing
Legislator-Zusammenfassung
KI-generiertThe case involves an appeal against a decision made by the Criminal Division of the Cantonal Court concerning allegations of embezzlement. The appeal was filed by an individual who argued that the relevant notification regarding the decision was not properly communicated to their current legal representative, thereby affecting their ability to respond within the designated time frame. However, the court ruled that the start of the appeal period was based on the date the prior representative received the decision, and thus, the appeal was deemed late. Consequently, the request for free legal assistance was denied, and the appellant was ordered to pay court costs.

Urteil vom 2. April 2009
Strafrechtliche Abteilung
Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.
Parteien
X.________,
Beschwerdeführer, vertreten durch Rechtsanwalt lic. iur. Heinz Birchler,
gegen
Staatsanwaltschaft des Kantons Solothurn, Franziskanerhof, Barfüssergasse 28,
4502 Solothurn, Beschwerdegegnerin.
Gegenstand
Veruntreuung usw.,
