Signature requirement for electronic appeal to Swiss Federal Supreme Court; failure to cure under Art. 42(5) BGG.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (Criminal Appeals Chamber) declined to enter into the appeal filed by the defendant (the appellant) and dismissed the case, leaving the lower court's decision of 31 October 2014 in force. The appellant had challenged a decision of the Zurich High Court (II. Criminal Chamber) concerning violations of the Road Traffic Act and related offenses. The Court based its decision on the appellant's failure to cure a formal defect: his electronically filed complaint lacked the required handwritten signature, and despite being notified on 11 February 2015 with a deadline of 25 February 2015 to remedy the issue, he submitted another unsigned email on 16 February 2015. Relying on Article 42(5) of the Federal Supreme Court Act (BGG) and applying the procedure under Article 108 BGG, the Court held that the appeal was inadmissible. No court costs were imposed, and, pursuant to Article 39(3) BGG, because the appellant did not provide a Swiss service address, the copy of the judgment intended for him was placed in the case file rather than being mailed.

Beschwerdegegnerin.
Gegenstand
Uebertretung des Strassenverkehrsgesetzes etc.,
Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, II. Strafkammer, vom 31. Oktober 2014 (SU140046-O/U/hb).
Der Präsident zieht in Erwägung:
