The case involves an individual who filed a complaint against a decision made by the Bern Cantonal Court regarding the non-prosecution of charges related to corruption and fraud. As the deadline to submit the appeal approached, the complainant requested an extension on the grounds of lacking suitable legal representation. However, the court denied the request for an extension, stating that such deadlines cannot be extended according to law, and noted that the complaint did not meet the required legal standards for submission. Consequently, the court ruled that it would not consider the appeal further.

Art. 100 BGG

Cited in the reasoning regarding the statutory deadline for the appeal.

Art. 106 Abs. 2 BGG

Cited in the reasoning to explain why the submission did not meet the formal requirements (lack of reasoning).

Art. 108 BGG

The appeal was not admitted based on this procedural provision because the submission did not meet the formal requirements.

Art. 42 Abs. 2 BGG

Cited in the reasoning to explain why the submission did not meet the formal requirements (lack of a request).

Art. 47 Abs. 1 BGG

Cited to confirm that the statutory deadline for filing the appeal cannot be extended.

Art. 64 LTF

Although not explicitly cited in the dispositive, the decision mentions waiving costs, which often relates to legal aid provisions, but since the dispositive only mentions 'Es werden keine Kosten erhoben' (No costs are levied), the relevant cost provision is Art. 66 LTF, which is not cited. However, since the reasoning mentions waiving costs, and the dispositive states 'Es werden keine Kosten erhoben', we must check if any cost/aid provision is cited. No cost/aid provision is explicitly cited in the dispositive orders 1-4. Therefore, only procedural/substantive provisions cited in 1-4 are included.

Urteil vom 2. März 2015

Strafrechtliche Abteilung

Besetzung

Bundesrichter Denys, Präsident,

Gerichtsschreiberin Arquint Hill.

Verfahrensbeteiligte

X.________,

Beschwerdeführer,

gegen

Generalstaatsanwaltschaft des Kantons Bern, Maulbeerstrasse 10, 3011 Bern,

Beschwerdegegnerin.

Gegenstand

Nichtanhandnahme (Korruption, Betrug etc.),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Bern, Strafabteilung, Beschwerdekammer in Strafsachen, vom 23. Dezember 2014.

Der Präsident zieht in Erwägung:

Lausanne, 2. März 2015

des Schweizerischen Bundesgerichts

Der Präsident: Denys
