A Swiss Federal Tribunal decision involved an individual who filed a complaint against a decision by the Public Prosecutor's Office of the Canton of Ticino to dismiss a criminal charge he had filed in February 2018. The complaint was declared inadmissible by the Court of Criminal Complaints of the Appellate Court of the Canton of Ticino in October 2018. The individual then appealed to the Swiss Federal Tribunal in December 2018. However, he failed to pay the required advance for court costs within the deadlines set by the Tribunal, leading to the eventual declaration of his appeal as inadmissible. The Tribunal concluded that the appellant's failure to comply with procedural requirements necessitated the dismissal of the appeal and imposed court costs on him.

Sentenza del 1° febbraio 2019

Corte di diritto penale

Composizione

Giudice federale Denys, Presidente,

Cancelliere Gadoni.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Ministero pubblico del Cantone Ticino,

opponente.

Oggetto

Decreto di abbandono,

ricorso contro la sentenza emanata il 25 ottobre 2018 dalla Corte dei reclami penali del Tribunale d'appello

del Cantone Ticino (incarto n. 60.2018.279).

Considerando:

che, con sentenza del 25 ottobre 2018, la Corte dei reclami penali del Tribunale d'appello del Cantone Ticino ha dichiarato irricevibile un reclamo presentato da A.________ contro un decreto di abbandono emanato dal Ministero pubblico in relazione con una sua denuncia penale del 19 febbraio 2018;

che avverso questo giudizio A.________ ha presentato il 1° dicembre 2018 un ricorso al Tribunale federale;

che con decreto presidenziale del 5 dicembre 2018 il ricorrente è stato invitato a fornire, entro il 4 gennaio 2019, un anticipo delle spese giudiziarie presunte di fr. 800.-- ( art. 62 cpv. 1 LTF );

che, con scritto del 31 dicembre 2018, il ricorrente ha contestato la mancata comunicazione della composizione della Corte giudicante e la richiesta dell'anticipo, senza tuttavia formulare né sostanziare una domanda di assistenza giudiziaria (cfr. art. 64 cpv. 1 LTF );

che, scaduto infruttuoso il suddetto termine di pagamento, con ulteriore decreto presidenziale del 10 gennaio 2019 al ricorrente è stato fissato un termine suppletorio non prorogabile, scadente il 24 gennaio successivo, per versare l'anticipo richiesto, con l'avvertenza che in caso di mancato pagamento il ricorso sarebbe stato dichiarato inammissibile ( art. 62 cpv. 3 LTF );

che il ricorrente non ha versato l'anticipo richiesto, né ha inoltrato alla Cassa del Tribunale federale un'attestazione di Postfinance o della banca che certifichi l'avvenuto addebito;

che, pertanto, come espressamente indicato nel secondo decreto presidenziale, il ricorso dev'essere dichiarato inammissibile ( art. 62 cpv. 3 LTF );

che le spese inutili sono messe a carico di chi le causa ( art. 66 cpv. 3 LTF );

richiamato l' art. 108 cpv. 1 lett. a LTF ;

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 500.-- sono poste a carico del ricorrente.

3. Comunicazione al ricorrente, al Ministero pubblico e alla Corte dei reclami penali del Tribunale d'appello del Cantone Ticino.
