Appeal on Detention Capacity Ruling Inadmissible Due to Failure to Exhaust Cantonal Remedies
Legislator-Zusammenfassung
KI-generiertThe case involves a complaint against a decision made by the Justice and Interior Directorate of a Swiss canton regarding the preparation of a report on the defendant's ability to serve time in prison. The complaint was filed by an individual who had not exhausted all available remedies within the cantonal legal system, leading to the Swiss Federal Tribunal determining that it could not consider the appeal at that stage. Consequently, the matter was referred back to the cantonal administrative court for further handling. There were no costs or compensations ordered as part of the proceedings.

KI-generiertCited in the reasoning to establish that the cantonal court was the final instance, which implies that the lack of exhaustion of remedies led to the decision not to enter upon the appeal (though the explicit ground for inadmissibility is not listed in the dispositive, this procedural context is heavily referenced alongside the decision not to enter).
Applied in point 3 of the dispositive as the basis for not allocating costs.
Cited in the reasoning concerning the structure of appealable decisions, supporting the procedural finding.
The decision not to enter upon the appeal (which is essentially a ruling on inadmissibility under Art. 93 LTF, although Art. 93 is implied by the outcome, it is not explicitly listed in the dispositive, therefore, it is excluded based on the strict rule.
