Definitive debt-collection enforcement upheld despite late payment of cost advance, constitutional complaint inadmissible for lack of specified rights violation.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Court (II. Civil Division) dismissed the appellant's constitutional complaint and rejected their request for free legal aid, upholding the lower court's decision not to enter into the appellant's appeal. The complaint challenged a cantonal appellate court's ruling that refused to consider the appellant's appeal against a first-instance order granting definitive debt collection relief (legal opening of enforcement) to the opposing party for amounts of CHF 5,845.71 and CHF 1,607.56. The appellate court declined to hear the appeal because the appellant paid a required court cost advance of CHF 450.00 one day after the deadline. The Federal Court held that, given the underestimate of the monetary threshold for appeals in property matters and the failure to raise a constitutional claim, only a subsidiary constitutional complaint was permissible; however, the appellant's submission lacked any invocation or detailed reasoning of a violation of constitutional rights as required by law. The court also noted that the appellant's claimed presence on a public holiday does not extend the deadline because both the appellant's domicile and the appellate court's seat were in a canton where that day was not a recognized holiday, and the cost advance was therefore late. The court imposed court costs of CHF 500.00 on the appellant.

Urteil vom 29. September 2008
II. zivilrechtliche Abteilung
Besetzung
Bundesrichter Raselli, Präsident,
Gerichtsschreiber Füllemann.
Parteien
X.________,
Beschwerdeführer,
gegen
Y.________,
Beschwerdegegner.
Gegenstand
in Erwägung,
