Legislator-Zusammenfassung

KI-generiert

The case involves a legal dispute where a person contested a definitive lifting of their opposition to a payment order amounting to 2,688 Swiss francs, which had been initiated by another party. The President of the Civil Court of the Sarine district had previously ruled in favor of lifting the opposition, and this decision was upheld by the II Civil Appeals Court of the Cantonal Court of Fribourg on January 11, 2019. The individual in question sought to challenge the decision of the Cantonal Court, arguing errors in the decision process and requesting a revocation of the court's January decision. However, the court declared their appeal inadmissible, emphasizing that the court’s decision had been made by the entire appellate court rather than its president alone, and indicating that no internal means of appeal existed against that specific decision. The individual proceeded to file a further complaint to the Swiss Federal Tribunal, which was handled as a subsidiary constitutional appeal due to the low value of the disputed amount and lack of broader legal significance. However, the Federal Tribunal found the submission to be inadequately motivated and declared it inadmissible, emphasizing that unfounded and abusive appeals would not be entertained.

Objet

6 § 3 let . c CEDH, art. 328 al. 2 CPC , art. 42 al. 5 LTF et art. 129 al. 1 CPP ). Faute d'être motivé conformément à l' art. 106 al. 2 LTF ( ATF 133 III 439 consid. 3.2; 136 I 332 consid.
