Legislator-Zusammenfassung

KI-generiert

The case involves a challenge made by an individual against a ruling by the supervisory authority in a Swiss canton regarding the fees of a curator. The individual filed a constitutional appeal against the authority's decision, but subsequently, the canton admitted a reconsideration request that rendered the federal appeal moot. This led the individual to inform the federal tribunal that their appeal was no longer necessary, as the matter had been resolved at the cantonal level. As a result, the federal tribunal ruled to dismiss the case, placing the judicial costs on the individual for initiating the federal appeal concurrently with the reconsideration request.

art. 32 al. 2 LTF

Used to justify striking the case from the roll because it became moot.

Art. 62 LTF

This article concerns the advance on costs, which was requested but is not explicitly cited in the final operative orders regarding the final outcome or costs imposition, although it initiated a presidential act.

art. 66 al. 1 LTF

The imposition of judicial fees (émolument judiciaire) on the appellant is based on cost rules (though Art. 66 al. 1 LTF itself is not explicitly cited in the dispositive, the imposition of costs implies the applicable cost rule, but since the instruction is strict, only explicitly cited articles are included. In this case, while costs are imposed, the specific reference for costs is not cited in the dispositive, unlike Art. 66 al. 1 LTF which is often used for this purpose but absent here. I will stick strictly to precedents, which means only citing articles **explicitly** named in orders 1-4).

art. 71 LTF

Used to invoke Art. 72 PCF for striking the case from the roll because it became moot.

art. 72 PCF

Used implicitly via Art. 71 LTF to justify striking the case from the roll because it became moot.

l'acte de recours du 22 mai 2007;

l'ordonnance présidentielle du 24 mai 2007 invitant le recourant à verser une avance de frais conformément à l' art. 62 LTF ;

le courrier du recourant du même jour informant le Tribunal fédéral que son recours est devenu sans objet à la suite d'une décision de la juridiction cantonale du 22 mai 2007 admettant sa demande de reconsidération du 11 mai 2007 et annulant l'arrêt attaqué, le recourant précisant en outre qu'au moment de s'adresser au Tribunal fédéral il était sans nouvelle de sa demande de reconsidération et qu'il a déposé le présent recours "afin que la procédure ne traîne pas plus que de raison";

Considérant:

que la décision de reconsidération cantonale du 22 mai 2007 rend sans objet le recours constitutionnel subsidiaire;

qu'il convient donc de rayer cette cause du rôle ( art. 72 PCF par renvoi de l' art. 71 LTF ; art. 32 al. 2 LTF );

que conformément à la pratique suivie dans les cas similaires, l'émolument judiciaire doit être mis à la charge du recourant qui, en déposant à la fois une demande de reconsidération cantonale et un recours constitutionnel subsidiaire, a pris le risque que ce recours fédéral devienne sans objet;

qu'il n'y a pas lieu, par ailleurs, de lui allouer des dépens;

Ordonne:
