The case involves a challenge to a decision from the Geneva Court of Justice, which dismissed an appeal regarding the definitive lifting of an opposition made by the appellant against a payment order. The appellant argued that the court's previous decision, which found her appeal insufficiently motivated and therefore inadmissible, breached her constitutional rights. However, the Federal Tribunal determined that the appellant failed to present a sufficient constitutional basis for her claims and that her appeal lacked the required legal motivation, leading to its rejection. Additionally, the court ruled that the appellant's implicit request for legal assistance should also be denied, and she would be responsible for the associated court costs.

Arrêt du 18 février 2013

IIe Cour de droit civil

Composition

Mme la Juge fédérale Hohl, Juge présidant.

Greffière: Mme de Poret Bortolaso.

Participants à la procédure

A.________,

recourante,

contre

que, par arrêt du 24 janvier 2013, la Cour de justice du canton de Genève a déclaré irrecevable le recours interjeté par la recourante contre un jugement, rendu le 7 janvier 2013 par le Tribunal de première instance et prononçant la mainlevée définitive de l'opposition qu'elle avait formée au commandement de payer qui lui était notifié à l'instance de l'intimée (valeur litigieuse inférieure à 30'000 fr.);

que la décision attaquée retient que dit recours était insuffisamment motivé ( art. 321 al. 1 CPC );

que, par le recours formé devant le Tribunal de céans, traité comme un recours constitutionnel subsidiaire, la recourante ne s'en prend aucunement aux considérants de la décision entreprise, n'invoque ainsi la violation d'aucun droit constitutionnel et ne démontre nullement, selon les exigences posées par les art. 116, 117 et 106 al. 2 LTF , la contrariété de l'arrêt cantonal à la Constitution;

que, faute de motivation conforme aux exigences légales en la matière, le recours est par conséquent irrecevable et doit être traité selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que la requête implicite d'assistance judiciaire de la recourante doit être rejetée ( art. 64 al. 1 LTF ) et les frais judiciaires mis à sa charge ( art. 66 al. 1 LTF );

par ces motifs, la Juge présidant prononce:

1. Le recours est irrecevable.

2. La requête d'assistance judiciaire est rejetée.
