Legislator-Zusammenfassung

KI-generiert

The case revolves around a legal dispute where a party challenged a decision made by a cantonal court that had definitively lifted an opposition to a payment order. The original ruling, issued in November 2015, concluded that the opposing party had a valid claim, a finding which the appellant contested in a subsequent appeal. The cantonal court deemed the appellant's challenge inadmissible, stating that it failed to adequately prove their claim regarding the opposing party's entitlement to a definitive release from opposition. The appellant's appeal to the higher court was also rejected on grounds of insufficient legal reasoning and was declared inadmissible, with costs imposed on the appellant.

Arrêt du 25 février 2016

IIe Cour de droit civil

Composition

M. le Juge fédéral von Werdt, Président.

Greffière : Mme de Poret Bortolaso.

Participants à la procédure

A.________,

recourante,

contre

État de Fribourg, service financier cantonal,

rue Joseph-Piller 13, 1700 Fribourg.

Objet

mainlevée définitive de l'opposition,

recours contre l'arrêt de la IIe Cour d'appel civil

du Tribunal cantonal de l'État de Fribourg

du 6 janvier 2016.

Considérant :

que, par arrêt du 6 janvier 2016, le Tribunal cantonal de l'État de Fribourg a déclaré irrecevable le recours formé par la recourante contre une décision rendue le 2 novembre 2015 par le Président du Tribunal civil de l'arrondissement de la Broye levant définitivement son opposition au commandement de payer notifié à l'instance de l'intimé (valeur litigieuse inférieure à 30'000 fr.);

que la juridiction cantonale a considéré que la recourante se contentait de contester la somme due, répétant les moyens déjà présentés devant la première instance sans démontrer que celle-ci se serait mépris sur le fait que l'intimé disposerait d'un titre de mainlevée définitive au sens de l' art. 80 LP ;

que le recours, traité comme un recours constitutionnel subsidiaire (art. 74 al. 1 let. b et al. 2 let. a LTF; art. 113 LTF ), ne satisfait manifestement pas aux exigences légales de motivation posées par les art. 116, 117 et 106 al. 2 LTF , la recourante se limitant à renvoyer aux déterminations présentées devant la première instance;

que, dans ces circonstances, le recours doit être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que les frais sont mis à la charge de la recourante qui succombe ( art. 66 al. 1 LTF );

par ces motifs, le Président prononce :

1. Le recours est irrecevable.
