Legislator-Zusammenfassung

KI-generiert

The case involves a dispute over the definitive lifting of an objection by a lower court's president regarding a payment order. The lower court had previously ruled that the objection was inadmissible and that the claimant did not adequately challenge the legitimacy of the debtor's claim. The higher court identified the appellant's arguments as insufficiently motivated and dismissed the appeal based on procedural grounds, concluding that the appellant merely reiterated previously presented arguments without demonstrating legal merit. The final decision affirmed the lower court's ruling and assigned the associated judicial costs to the appellant.

Arrêt du 25 février 2016

IIe Cour de droit civil

Composition

M. le Juge fédéral von Werdt, Président.

Greffière : Mme de Poret Bortolaso.

Participants à la procédure

A.________,

recourante,

contre

B.________ AG,

intimée.

Objet

mainlevée définitive de l'opposition,

recours contre l'arrêt de la IIe Cour d'appel civil

du Tribunal cantonal de l'État de Fribourg

du 6 janvier 2016.

Considérant :

que, par arrêt du 6 janvier 2016, le Tribunal cantonal de l'État de Fribourg a déclaré manifestement irrecevable le recours formé par la recourante contre une décision rendue le 3 novembre 2015 par le Président du Tribunal civil de la Broye levant définitivement son opposition au commandement de payer notifié à l'instance de l'intimée (valeur litigieuse inférieure à 30'000 fr.);

que la cour cantonale a jugé que la recourante se contentait de contester la somme due, répétant les moyens déjà présentés devant la première instance sans démontrer que celle-ci se serait mépris sur le fait que l'intimée disposerait d'un titre de mainlevée définitive au sens de l' art. 80 LP ;

que le recours, traité comme un recours constitutionnel subsidiaire (art. 74 al. 1 let. b et al. 2 let. a LTF; art. 113 LTF ), ne satisfait manifestement pas aux exigences légales de motivation posées par les art. 116, 117 et 106 al. 2 LTF , la recourante se limitant à renvoyer aux déterminations présentées devant la première instance;

que, dans ces circonstances, le recours doit être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que les frais sont mis à la charge de la recourante qui succombe ( art. 66 al. 1 LTF );

par ces motifs, le Président prononce :

1. Le recours est irrecevable.
