Cantonal Court Refusal to Hear Appeal on Debt Enforcement Due to Formal Defects Upheld by Federal Supreme Court Lack of Specific Grounding in Constitutional Appeal
Legislator-Zusammenfassung
KI-generiertIn this case, an individual sought to challenge a lower court's decision that had denied their application to lift a legal opposition in a debt collection proceeding involving a claim of 5,000 currency units. The cantonal civil court refused to consider the appeal due to insufficient clarity and precision in the recourse submission, failing to address the relevant points of law and fact or provide meaningful conclusions. When the matter escalated to the federal tribunal, the appellant focused on the validity of their claim rather than addressing the procedural shortcomings identified by the lower court, leading the federal court to declare the appeal inadmissible due to lack of proper motivation and impose costs on the appellant.

Objet
mainlevée d'opposition,
recours constitutionnel contre la décision de la Chambre civile du Tribunal cantonal du canton du Valais du 30 novembre 2011.
Considérant:
qu'aux termes de la décision attaquée, la Chambre civile cantonale a refusé d'entrer en matière sur un recours formé par A.________ contre un prononcé du 2 novembre 2011 rejetant sa requête de mainlevée d'opposition dans une poursuite exercée contre l'intimé pour un montant de 5'000 fr.;
qu'elle a considéré, en effet, que l'écriture du recourant ne répondait pas aux exigences de forme découlant des art. 320 et 321 CPC , faute d'exposer de manière claire et précise sur quels points, de fait ou de droit, et pour quels motifs, le prononcé en question était contesté et faute, en outre, de contenir des conclusions;
que devant le Tribunal fédéral, le recourant discute le bien-fondé de sa créance, mais ne s'en prend nullement aux considérants de l'autorité précédente traitant de la recevabilité du recours cantonal;
que le présent recours étant ainsi dépourvu de motivation conforme aux exigences des art. 116 et 117/106 al. 2 LTF, il convient de le déclarer irrecevable en procédure simplifiée ( art. 108 al. 1 let. b LTF ), aux frais de son auteur ( art. 66 al. 1 LTF );
par ces motifs, la Présidente prononce:
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.
3. Le présent arrêt est communiqué aux participants à la procédure et à la Chambre civile du Tribunal cantonal du canton du Valais.
