Legislator-Zusammenfassung

KI-generiert

The case involves a dispute where one party appealed against a decision by a cantonal court regarding the provisional lifting of an opposition to a payment order. The initial decision had allowed the lifting of the opposition only up to a certain acknowledged amount of interest owed. The cantonal court dismissed the appeal, stating that the appellant did not provide sufficient grounds for a more extensive claim, particularly failing to contest the trial judge's basis for calculations. The federal court ruled the subsequent appeal as inadmissible, citing inadequate justification from the appellant as per procedural law, and ordered the appellant to bear the judicial costs.

Objet

mainlevée provisoire de l'opposition,

recours constitutionnel contre la décision du Tribunal cantonal du canton du Valais, Chambre civile, du 23 octobre 2013.

Considérant:

que, par décision du 23 octobre 2013, le Tribunal cantonal du canton du Valais a rejeté un recours formé par A.________ contre une décision, rendue le 25 avril 2013 par la juge suppléante du Tribunal de district de Monthey, décision levant provisoirement, à concurrence du seul montant de xxxx fr., l'opposition formée par l'intimé au commandement de payer notifié à l'instance du recourant;

que le Tribunal cantonal a retenu que le recourant ne contestait pas l'opinion de la première juge selon laquelle il ne lui appartenait pas de procéder à des calculs complexes pour déterminer l'éventuel solde de la dette dont l'intimé restait redevable, la mainlevée ne pouvant ainsi être accordée que pour le montant des intérêts, lequel était reconnu par les deux parties;

que la juridiction a également souligné que la répartition des frais de justice était correcte dès lors que l'intéressé n'avait que partiellement obtenu gain de cause;

que, devant le Tribunal de céans, le recourant se limite à indiquer que son adverse partie lui devrait un montant de xxxx fr.;

qu'à l'évidence cette motivation ne satisfait pas aux exigences posées par les art. 116 et 117/106 al. 2 LTF, de sorte que le recours doit être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que les frais judiciaires sont mis à la charge du recourant qui succombe ( art. 66 al. 1 LTF );

par ces motifs, le Président prononce:

1. Le recours est irrecevable.
