Legislator-Zusammenfassung

KI-generiert

In this case, an individual filed a constitutional appeal against a decision made by the Geneva Court of Justice, which had declared the individual's appeal against a provisional lift of opposition in an enforcement proceeding to be inadmissible. The court found that the appeal lacked sufficient motivation and that the conditions for the provisional lift were evidently met. The individual later submitted a constitutional appeal to the Federal Tribunal, but the appeal was deemed manifestly insufficient as it did not invoke any constitutional rights or challenge the reasoning of the lower court. Consequently, the Federal Tribunal ruled the appeal as inadmissible and imposed the court fees on the appellant.

Objet

mainlevée d'opposition,

recours constitutionnel contre l'arrêt de la Chambre civile de la Cour de justice du canton de Genève du 4 octobre 2011.

Considérant:

que, par arrêt du 4 octobre 2011, la Cour de justice du canton de Genève a déclaré irrecevable l'appel formé par A.________ contre le prononcé de la mainlevée provisoire de l'opposition dans la poursuite exercée par Fondation B.________;

que cette décision retient que le recours ne satisfaisait pas aux exigences de recevabilité posées par l' art. 321 al. 1 CPC , faute de motivation suffisante, et, qu'au demeurant, il serait mal fondé, les conditions pour prononcer la mainlevée provisoire étant manifestement réalisées;

que, par écritures remises à la poste le 28 octobre 2011, A.________ interjette un recours constitutionnel subsidiaire au Tribunal fédéral contre cette décision;

que, toutefois, le recourant n'invoque la violation d'aucun droit constitutionnel ni ne prétend que l'arrêt cantonal serait arbitraire ( art. 106 al. 2 LTF );

qu'en outre, il ne s'en prend pas aux considérants de l'arrêt cantonal mais fait valoir de manière sommaire des griefs matériels;

qu'une telle argumentation est manifestement insuffisante au regard des exigences légales en la matière ( art. 116, 117 et 106 al. 2 LTF ; ATF 133 IV 286 consid. 1.4);

que le recours doit dès lors être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que les frais de la présente procédure doivent être mis à la charge du recourant ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
