Legislator-Zusammenfassung

KI-generiert

The case involves a constitutional appeal concerning the rejection of a recusal request against a cantonal judge, which was made by the appellant. The judge had previously deemed the appellant's response to a ruling on the lifting of an objection to be incomprehensible, prompting the appellant to claim the judge lacked intelligence and made derogatory assertions. The cantonal court found these claims unsubstantiated and aimed at defamation rather than legitimate concerns about the judge's impartiality. The appeal to the Federal Tribunal was deemed manifestly unfounded, lacking proper justification, and was therefore declared inadmissible, with costs assigned to the appellant.

Arrêt du 4 novembre 2011

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffier: M. Fellay.

Participants à la procédure

A.________,

recourant,

contre

Vu:

l'arrêt attaqué, qui rejette comme étant manifestement mal fondée au regard de l' art. 47 CPC une demande de récusation déposée par A.________ à l'encontre du juge cantonal intimé suite à un avis de celui-ci accusant réception de son recours contre un prononcé de mainlevée d'opposition (poursuite n° xxxx) et jugeant ce recours incompréhensible;

les considérants de la cour cantonale, à savoir en substance que le prénommé s'est contenté d'affirmer que le juge intimé était doté d'un "Q.I. insuffisant" et atteint "d'idiotie", qu'il n'a invoqué aucun élément pertinent susceptible de faire apparaître le juge comme prévenu à son égard et qu'il a semblé plutôt agir dans le seul but de dénigrer celui-ci;

le recours de A.________ au Tribunal fédéral, traité comme recours constitutionnel compte tenu de la valeur litigieuse de 1'294 fr. 45 communiquée par la cour cantonale ( art. 113 LTF );

considérant:

que le Tribunal fédéral ne connaît de la violation de droits fondamentaux ( art. 116 LTF ) que si ce grief a été soulevé et motivé par le recourant ( art. 106 al. 2 LTF ), ce dernier devant, dans son mémoire, exposer en quoi consiste la violation alléguée, c'est-à-dire discuter les motifs de la décision entreprise et indiquer précisément en quoi il estime que l'autorité précédente a méconnu ses droits constitutionnels (cf. ATF 133 II 249 consid. 1.4.2; 133 IV 286 consid. 1.4);

qu'en l'espèce, le recours ne répond manifestement pas à ces exigences de motivation et s'avère même abusif ( art. 42 al. 7 LTF ), de sorte qu'il y a lieu de le déclarer irrecevable en procédure simplifiée (art. 108 al. 1 let. b et c LTF), aux frais de son auteur ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
