Legislator-Zusammenfassung

KI-generiert

The case involves a legal dispute in which an individual filed a constitutional appeal against a decision from a cantonal court, which had declared their appeal inadmissible following the withdrawal of a request for enforcement. The cantonal court reasoned that the individual had not presented any specific claims in their appeal or subsequent submissions, nor did they argue against the withdrawal of the request during the hearing. The individual subsequently escalated the matter to the federal court, but the appeal was found to be insufficient as it failed to invoke any constitutional rights violations or address the legal reasoning of the cantonal decision. As a result, the federal court deemed the appeal inadmissible and imposed costs on the appellant.

Objet

mainlevée d'opposition,

recours constitutionnel contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 18 janvier 2011.

Considérant:

que, par arrêt du 18 janvier 2011, la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud a déclaré irrecevable le recours formé par A.________ à la suite du prononcé du Juge de paix du district de La Riviera - Pays-d'Enhaut, prenant acte du retrait par celle-ci de sa requête de mainlevée;

que, d'une part, dite décision est motivée par le fait que ni le recours ni l'écriture déposée à la suite de l'invitation du président de la cour cantonale en vue de remédier aux irrégularités formelles, ne contenait de conclusions;

que, d'autre part, la cour cantonale a constaté que la recourante n'avait même pas prétendu ne pas avoir retiré sa requête de mainlevée lors de l'audience;

que, par écritures du 15 février 2002, A.________ interjette un recours constitutionnel subsidiaire au Tribunal fédéral contre cet arrêt;

que, toutefois, la recourante n'invoque la violation d'aucun droit constitutionnel ni ne prétend que l'arrêt cantonal serait arbitraire ( art. 106 al. 2 LTF );

que, en outre, elle ne s'en prend pas aux considérants de l'arrêt cantonal mais se borne à présenter sa propre version des faits;

qu'une telle argumentation est manifestement insuffisante au regard des exigences légales en la matière ( art. 106 al. 2 LTF ; ATF 133 IV 286 consid. 1.4);

que le recours doit dès lors être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que les frais de la présente procédure doivent être mis à la charge de la recourante ( art. 66 al. 1 LTF );

par ces motifs, la Juge présidant prononce:

1. Le recours est irrecevable.
