Company v. Public Entity: Inadmissibility Due to Unpaid Court Fees
Legislator-Zusammenfassung
KI-generiertA company filed an appeal against a decision from the Court of Enforcement and Bankruptcy of the Cantonal Tribunal of Vaud, which involved an objection to a debt enforcement proceeding initiated by the State of Vaud, represented by the Tax Office for Legal Entities. The Federal Tribunal categorized the appeal as a subsidiary constitutional appeal. Despite being required to make an advance payment for the procedure, the company failed to pay the necessary fee by the deadline, which led to the judicial authorities notifying that the payment had neither been made nor credited to their account. Consequently, the appeal was declared inadmissible following a simplified procedure due to non-compliance with the advance payment requirement.
