Legislator-Zusammenfassung

KI-generiert

The case involves a disputing party challenging a prior decision made by a cantonal court, which had determined that an opposition to a payment command had been definitively lifted. The claimant's appeal was deemed inadmissible by the cantonal court due to insufficient motivation of the arguments presented for the appeal and a lack of proof supporting claims of judicial bias. The decision noted that the claimant failed to demonstrate any constitutional rights violations by the cantonal authority. Consequently, the appeal was rejected on procedural grounds, and the claimant was held responsible for the associated judicial costs.

Objet

mainlevée définitive de l'opposition,

recours contre la décision du Tribunal cantonal

du canton du Valais, Juge unique de la Chambre civile, du 25 septembre 2015 (C3 15 127).

Considérant :

que, par décision du 25 septembre 2015, le Tribunal cantonal du canton du Valais a déclaré irrecevable le recours déposé par la recourante contre une décision rendue le 11 août 2015 par la juge suppléante des districts d'Hérens et Conthey, décision levant définitivement l'opposition formée par l'intéressée au commandement de payer notifié à l'instance de l'intimé (valeur inférieure à 30'000 fr.);

que la décision entreprise retient que l'acte de recours ainsi que son complément ne satisfaisaient pas aux exigences de motivation posées par l' art. 321 CPC , que les motifs invoqués par la recourante pour fonder une éventuelle récusation des juges ayant traité son dossier n'étaient de surcroît pas suffisants pour fonder leur prétendue partialité et qu'au demeurant, la décision rendue par le premier juge ne prêtait pas le flanc à la critique dès lors que l'intimé était au bénéfice d'un jugement exécutoire sans que la recourante n'apportât la preuve d'un moyen libératoire;

que la motivation développée par la recourante est incompréhensible, celle-ci n'exposant par ailleurs nullement quels droits constitutionnels l'autorité cantonale aurait violés et pourquoi;

que, faute de satisfaire aux exigences légales de motivation ( art. 116, 117 et 106 al. 2 LTF ), son recours doit en conséquence être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que, vu l'issue du recours, la requête d'assistance judiciaire présentée par la recourante doit être rejetée ( art. 64 al. 1 LTF ), les frais judiciaires étant mis à sa charge ( art. 66 al. 1 LTF );

par ces motifs, le Président prononce :

1. Le recours est irrecevable.

2. La requête d'assistance judiciaire est rejetée.
