Inadmissibility of Appeal Regarding Recusal of District Court President in Debt Enforcement Proceedings
Legislator-Zusammenfassung
KI-generiertThe case revolves around a constitutional appeal filed by an individual against a decision made by the president of a judicial district in the context of enforcement proceedings. The appeal challenged a prior ruling that dismissed the individual's request for disqualification of the president in relation to opposition release procedures. The court found the appeal to be manifestly inadmissible, primarily due to the lack of sufficient justification concerning the alleged violations of constitutional rights, and categorized the attempt as abusive. Consequently, the court imposed judicial costs on the appellant and indicated any further similar actions would be disregarded.

Arrêt du 19 novembre 2009
IIe Cour de droit civil
Composition
Mme la Juge Hohl, Présidente.
Greffier: M. Fellay.
Parties
X.________,
recourant,
contre
Président 3 de l'arrondissement judiciaire I Courtelary-Moutier-La Neuveville,
intimé.
Objet
récusation (mainlevée d'opposition),
recours constitutionnel contre la décision de la 2ème Chambre civile de la Cour d'appel du canton de Berne
du 4 novembre 2009.
Considérant:
que la décision attaquée rejette, dans la mesure où elle est recevable, une demande de récusation formée par X.________ à l'encontre du président d'arrondissement judiciaire intimé dans le cadre de procédures de mainlevée d'opposition;
que contrairement aux exigences de l' art. 106 al. 2 LTF (par renvoi de l' art. 117 LTF ), le recourant n'indique nullement en quoi la décision attaquée violerait ses droits constitutionnels;
que le recours étant ainsi manifestement irrecevable et se révélant de surcroît une nouvelle fois abusif ( art. 42 al. 7 LTF ), il convient, en procédure simplifiée selon l'art. 108 al. 1 let. b et c LTF, de ne pas entrer en matière;
qu'en vertu de l' art. 66 al. 1 LTF , les frais judiciaires doivent être mis à la charge du recourant;
