Legislator-Zusammenfassung

KI-generiert

In this case, an individual sought to challenge the refusal of a request for the recusal of a magistrate in a legal proceeding concerning the lifting of an opposition. The initial decision was made by the 2nd Civil Chamber of the Court of Appeal of the Supreme Court of the canton of Bern, which rejected the recusal request. The matter involved a dispute with a value of 300 francs, which limited the type of legal recourse available. The appeal was subsequently treated as a constitutional complaint; however, it was deemed inadequate because the appellant did not sufficiently substantiate the claims of arbitrariness and violation of constitutional rights, leading to the appeal being declared inadmissible.

Arrêt du 19 novembre 2009

IIe Cour de droit civil

Composition

Mme la Juge Hohl, Présidente.

Greffière: Mme Aguet.

Parties

X.________,

recourant,

contre

Président 3 de l'arrondissement judiciaire I Courtelary-Moutier-La Neuveville,

intimé.

Objet

récusation (mainlevée d'opposition),

recours constitutionnel contre la décision de la 2ème Chambre civile de la Cour d'appel de la Cour suprême du canton de Berne du 4 novembre 2009.

considérant:

que, par arrêt du 4 novembre 2009, la 2ème Chambre civile de la Cour d'appel du canton de Berne a rejeté la requête de X.________ tendant à la récusation du Président 3 de l'arrondissement judiciaire I Courtelary-Moutier-La Neuveville;

que la décision attaquée concerne la récusation d'un magistrat dans une procédure de mainlevée dont la valeur litigieuse s'élève à 300 fr., de sorte que le recours en matière civile n'est pas ouvert (art. 72 al. 2 let. a et 74 al. 1 let. b LTF);

que, dès lors, l'écriture déposée par le recourant doit être traitée en tant que recours constitutionnel au sens des art. 113 ss LTF ;

que, saisi d'un tel recours, le Tribunal fédéral ne connaît de la violation de droits fondamentaux que si ce grief a été invoqué et motivé par le recourant (art. 106 al. 2, par renvoi de l' art. 117 LTF ), les exigences de motivation correspondant à celles de l'art. 90 al. 1 let. b aOJ ( ATF 133 III 439 consid. 3.2 p. 444);

que, en l'espèce, le recours ne satisfait aucunement à ces exigences, le recourant se plaignant du fait que l'arrêt attaqué est arbitraire et contraire aux droits constitutionnels, sans toutefois développer ses griefs ni s'en prendre aux motifs de la juridiction cantonale;

que, dès lors, le recours doit être déclaré irrecevable ( art. 108 al. 1 let. b LTF ), aux frais de son auteur ( art. 66 al. 1 LTF );

que le présent arrêt relève de la compétence du juge unique ( art. 108 al. 1 LTF );

que de nouvelles écritures du même style dans la présente cause, en particulier des demandes abusives de révision, seront classées sans suite;

par ces motifs, vu l' art. 108 al. 1 LTF , la Présidente prononce:

1. Le recours est irrecevable.
