The Swiss Federal Tribunal (II Civil Law Division) declared the appellant’s subsidiary constitutional law appeal inadmissible as manifestly late, thereby upholding the cantonal appellate court’s decision of 9 September 2014, which had rejected the appellant’s complaint against the trial court’s allocation of procedural costs and party compensation in a divorce modification proceeding. The challenged ruling on costs and compensation thus remains in force. The Court found that the 30-day appeal deadline under Art. 100 para. 1 LTF began on 12 September 2014 following notification on 11 September 2014 and expired on 13 October 2014 (since 11 October 2014 was a Saturday, per Art. 45 para. 1 LTF); although the appellant handed the filing to the German postal service on 13 October 2014, it was received by Swiss Post only on 14 October 2014, failing the timely delivery requirement of Art. 48 para. 1 LTF. The Court also denied the appellant’s implicit request for legal aid due to lack of prospects of success (Art. 64 paras. 1 and 3 LTF) and imposed judicial costs of CHF 300 on the appellant (Art. 66 para. 1 LTF).

Sentenza del 17 ottobre 2014

II Corte di diritto civile

Composizione

Giudice federale von Werdt, Presidente,

Cancelliera Antonini.

Partecipanti al procedimento

A.________,

ricorrente,

contro

B.________,

patrocinata dall'avv. Federica Pampanin Gadella,

opponente.

Oggetto

Considerando:

che con petizione 29 marzo 2011 B.________ ha presentato nei confronti di A.________ un'azione di completamento rispettivamente di modifica della sentenza di divorzio pronunciata in data 11 agosto 2010 da un tribunale lituano;

che con decisione 26 marzo 2013 il Pretore del Distretto di Lugano ha statuito sulla petizione, ponendo le spese processuali di fr. 1'200.-- per 1/3 a carico dell'attrice e per 2/3 a carico del convenuto e condannando B.________ e A.________ a versare alla controparte fr. 178.20 rispettivamente fr. 6'980.-- di spese ripetibili;

che con sentenza 9 settembre 2014 la III Camera civile del Tribunale d'appello del Cantone Ticino ha respinto un reclamo introdotto da A.________ contro la ripartizione delle spese processuali e ripetibili decisa dal Pretore;

che con ricorso sussidiario in materia costituzionale A.________ è insorto dinanzi al Tribunale federale chiedendo l'annullamento della sentenza cantonale ed il rinvio dell'incarto al Pretore per nuovo giudizio, postulando anche (implicitamente) di essere posto al beneficio dell'assistenza giudiziaria;

che il ricorso contro una decisione deve essere depositato presso il Tribunale federale entro trenta giorni dalla notificazione del testo integrale della decisione ( art. 100 cpv. 1 LTF );

che il termine è osservato ove lo scritto sia consegnato al Tribunale federale oppure, all'indirizzo di questo, alla posta svizzera o a una rappresentanza diplomatica o consolare svizzera al più tardi l'ultimo giorno del termine ( art. 48 cpv. 1 LTF );

che la sentenza impugnata è stata notificata al ricorrente l'11 settembre 2014;

che il termine per adire il Tribunale federale ha quindi cominciato a decorrere il 12 settembre 2014 ( art. 44 cpv. 1 LTF ) per scadere l'11 ottobre 2014;

che, essendo l'11 ottobre 2014 un sabato, l'ultimo giorno utile per il deposito del ricorso era lunedì 13 ottobre 2014 ( art. 45 cpv. 1 LTF );

che il ricorrente ha consegnato il suo gravame alla posta tedesca il 13 ottobre 2014, ma la posta svizzera ha ricevuto in consegna l'invio soltanto il 14 ottobre 2014;

che in queste circostanze il ricorso si appalesa tardivo e quindi inammissibile;

che giusta l' art. 108 cpv. 1 lett. a LTF il Presidente della Corte decide in procedura semplificata sulla non entrata nel merito di ricorsi manifestamente inammissibili;

che l'implicita domanda di assistenza giudiziaria deve essere respinta per mancanza di possibilità di esito favorevole del ricorso ( art. 64 cpv. 1 e 3 LTF );

che le spese giudiziarie seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.
