The case involves a legal dispute concerning the lifting of an objection related to a payment command. A party filed a constitutional appeal against a decision made by the civil court in the canton of Neuchâtel, which granted the opposing party a definitive lifting of the objection against the payment command amounting to less than 30,000 CHF. The appeal was deemed inadmissible due to lack of proper motivation and was also found to be clearly unfounded, as the judge could only evaluate the enforceability of the claims presented, rather than their validity. Consequently, the court ruled that the appeal was incomprehensible and did not meet the legal requirements, leading to the imposition of court fees on the appealing party.

Arrêt du 30 août 2012

IIe Cour de droit civil

Composition

Mme la Juge fédérale Hohl, Présidente.

Participants à la procédure

A.________,

recourant,

contre

que, par arrêt du 6 août 2012, l'autorité de recours en matière civile du Tribunal cantonal du canton de Neuchâtel a déclaré irrecevable, et, au surplus, clairement mal fondé, le recours déposé devant elle par le recourant contre une décision, rendue le 26 juin 2012 par le Tribunal civil du Littoral et du Val-de-Travers, par laquelle cette dernière juridiction octroyait aux intimés la mainlevée définitive de l'opposition formée par l'intéressé au commandement de payer qui lui était notifié (somme inférieure à 30'000 fr.);

que, selon l'arrêt attaqué, le recours était irrecevable faute de motivation pertinente ( art. 321 al. 1 CPC ), et que, pour le surplus, il était clairement mal fondé dès lors que le juge de mainlevée ne pouvait pas se prononcer sur la pertinence et le bien-fondé des titres de mainlevée, seul le caractère définitif et exécutoire des décisions invoquées par le créancier poursuivant devant être examiné, grief qui n'était toutefois pas soulevé en l'espèce;

qu'en l'occurrence, le recours est incompréhensible et ne satisfait a fortiori nullement aux exigences posées par les art. 116, 117 et 106 al. 2 LTF ;

que, faute de motivation conforme aux exigences légales en la matière, le recours est par conséquent irrecevable et doit être traité selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;

que les frais judiciaires doivent être mis à la charge du recourant ( art. 66 al. 1 LTF );

par ces motifs, la Présidente prononce:

1. Le recours est irrecevable.
