Appeal Inadmissibility Due to Lack of Motivation
Legislator-Zusammenfassung
KI-generiertIn this case, an individual filed a constitutional appeal against a previous decision made by the Cantonal Court regarding the definitive lifting of an opposition. Although the appeal was submitted within the legal deadline, it lacked any motivation, which is a requirement for such filings. As the appeal did not meet the necessary legal standards for acceptance, the court found it inadmissible and ruled that the appellant would bear the judicial costs associated with the process.

Objet
mainlevée définitive de l'opposition,
recours constitutionnel contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 2 septembre 2008.
considérant:
qu'un recours au Tribunal fédéral doit être déposé dans le délai ( art. 100 al. 1 LTF ) et la forme ( art. 42 LTF ) prévus par la loi;
qu'en l'espèce, le recours a certes été déposé dans le délai légal, mais il ne contient aucune motivation;
que le délai de l' art. 100 al. 1 LTF étant échu et ne pouvant être prolongé ( art. 47 al. 1 LTF ), il n'y a pas lieu de fixer au recourant, comme il le demande, un délai pour présenter un mémoire complémentaire;
que le recours doit par conséquent être déclaré irrecevable en procédure simplifiée ( art. 108 al. 1 LTF ), aux frais de son auteur ( art. 66 al. 1 LTF );
par ces motifs, le Président prononce:
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 1'000 fr., sont mis à la charge du recourant.
3. Le présent arrêt est communiqué aux parties et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.
