Negative declaratory action and debt collection annulment: constitutional recourse declared inadmissible for insufficient reasoning on alleged constitutional violations.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declared the appellant's constitutional subsidiary recourse inadmissible, upholding the lower court's decision. The cantonal court had dismissed the appellant's appeal as manifestly inadmissible for insufficient reasoning, thereby leaving in force the first-instance ruling that admitted the respondent's negative declaratory action (action négatoire), confirmed the parties had no legal relationship, and annulled a debt collection proceeding initiated by the appellant. The dispute arose from the appellant's challenge to a debt collection and denial of any obligation, which the lower courts dismissed. The Federal Supreme Court based its decision on procedural grounds, holding that the appellant failed to meet the strict substantiation requirements for constitutional complaints under Articles 116, 117, and 106(2) of the Federal Supreme Court Act (LTF), as he did not clearly and precisely demonstrate how the cantonal decision violated the constitution, instead offering general criticisms and irrelevant arguments. Costs of CHF 300 were imposed on the appellant.

Objet
action négatoire, annulation d'une poursuite,
recours constitutionnel contre l'arrêt du Tribunal cantonal de l'État de Fribourg, Ie Cour d'appel civil, du 9 juillet 2015.
Considérant :
que, par arrêt du 9 juillet 2015, la Ie Cour d'appel civil du Tribunal cantonal de l'État de Fribourg, a déclaré manifestement irrecevable l'appel formé par A.________ (ci-après : le recourant) contre une décision rendue le 2 juin 2015 par le Président du Tribunal civil de la Sarine par laquelle celui-ci admettait l'action négatoire introduite par B.________ (ci-après : l'intimé) contre le recourant, constatait que les parties n'étaient liées par aucun rapport de droit et d'obligation, que l'intimé ne devait pas la somme de 20'000 fr. au recourant et annulait la poursuite qui avait été introduite à son encontre à l'instance du recourant;
que l'arrêt attaqué retient que la motivation développée par le recourant était insuffisante et sans aucune pertinence, le recourant se limitant en effet à formuler des critiques toutes générales en mêlant la cause à juger à d'autres affaires, menaçant également les autorités de plaintes pénales et procédant à des développements incompréhensibles en lien avec les travaux au sein de la copropriété par étages à laquelle appartenaient les parties;
qu'à l'évidence, le recours, traité comme un recours constitutionnel subsidiaire (art. 74 al. 1 let. b et al. 2 let. a LTF; art. 113 LTF ), ne satisfait pas aux exigences légales de motivation posées par les art. 116, 117 et 106 al. 2 LTF , le recourant ne démontrant pas clairement et avec précision, en se référant aux considérants pertinents de l'arrêt cantonal, en quoi celui-ci violerait la constitution;
que, dans ces circonstances, le recours doit être déclaré manifestement irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF ;
que les frais judiciaires sont mis à la charge du recourant qui succombe ( art. 66 al. 1 LTF );
par ces motifs, le Président prononce :
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.
3. Le présent arrêt est communiqué aux parties et au Tribunal cantonal de l'État de Fribourg, I
e Cour d'appel civil.
