Debtor's Failure to Justify Constitutional Complaint Against Enforcement Ruling
Legislator-Zusammenfassung
KI-generiertThe case involves a party seeking to contest a provisional lifting of an objection made by another party in a debt enforcement process. The court of first instance rejected the request for motivation due to it being submitted late, leading to an appeal to a higher court. The appellant did not sufficiently demonstrate how the lower court's decision violated constitutional rights, focusing instead on disputing the validity of the debt. Consequently, the appeal was deemed manifestly inadmissible, and the costs of the judicial proceedings were assigned to the appellant.

Arrêt du 29 octobre 2008
IIe Cour de droit civil
Composition
M. le Juge Raselli, Président.

Parties
X.________,
recourante,
contre
Y.________ AG,
intimée.
Objet
mainlevée provisoire de l'opposition,
recours constitutionnel contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 21 août 2008.
Considérant:
que l'arrêt attaqué confirme une décision du Juge de paix du district de Payerne écartant, pour cause de tardiveté, la demande de motivation d'un prononcé de mainlevée d'opposition présentée par X.________ dans le cadre de la poursuite n° xxx exercée contre elle par Y.________ AG;
que contrairement aux exigences de l' art. 106 al. 2 LTF (par renvoi de l' art. 117 LTF ), inspirées de l' art. 90 al. 1 let. b OJ ( ATF 133 III 393 consid. 6), la recourante n'indique nullement en quoi l'arrêt attaqué violerait ses droits constitutionnels, se bornant à contester le bien-fondé de la créance en poursuite;
que le recours étant ainsi manifestement irrecevable, il convient, en procédure simplifiée selon l' art. 108 al. 1 let. a LTF , de ne pas entrer en matière;
qu'en vertu de l' art. 66 al. 1 LTF , les frais judiciaires doivent être mis à la charge de la recourante;
par ces motifs, le Président prononce:
1. Le recours est irrecevable.
2. Les frais judiciaires, arrêtés à 500 fr., sont mis à la charge de la recourante.
3. Le présent arrêt est communiqué aux parties et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.
