Legislator-Zusammenfassung

KI-generiert

The case involves a constitutional appeal filed by an individual against a decision made by the public law court of a Swiss canton regarding the dismissal of a claim related to costs and guardianship. The appellant requested legal aid in the context of this appeal. However, the appellant later withdrew the appeal, leading to the court recognizing this withdrawal and proceeding to dismiss the case. Consequently, the request for legal aid was denied, and the appellant was ordered to bear the judicial costs incurred up to that point.

art. 32 al. 2 LTF

This provision establishes the competence of the instructing judge to rule on the matter, not a decision rendered in the dispositive orders themselves, but rather the basis of the authority signing the ordonnance. However, since it is a procedural basis for the judge's action leading to the dispositive, and in the absence of a clearer main ground, it is noted in the context of the procedure.

art. 65 LTF

This provision is cited regarding the determination of the judicial fee (which is then applied in Order 3).

art. 66 al. 1 et 2 LTF

This provision is cited to justify charging the judicial costs to the appellant (Order 3).

art. 73 PCF par renvoi de l' art. 71 LTF

This provision (via Art. 71 LTF) is cited in the reasoning that justifies taking note of the withdrawal and striking the case from the roll (Order 1 implicitly follows this, as Order 1 is the direct consequence).

art. 5 al. 2 PCF par renvoi de l' art. 71 LTF

This provision is cited to justify rejecting the request for legal aid (Order 2).

Objet

dépens (responsabilité, tutelle),

recours constitutionnel contre la décision de classement de la Cour de droit public du Tribunal administratif du canton de Neuchâtel du 2 juillet 2010.

Vu:

le recours constitutionnel subsidiaire de A.________ du 3 septembre 2010, assorti d'une demande d'assistance judiciaire;

l'ordonnance présidentielle du 8 septembre 2010, différant la décision concernant l'assistance judiciaire;

la déclaration de retrait de A.________ du 22 novembre 2011, postée le lendemain;

considérant:

qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle ( art. 73 PCF par renvoi de l' art. 71 LTF );

que le juge instructeur est compétent pour statuer à cet effet ( art. 32 al. 2 LTF );

que le recourant s'étant désisté, l'assistance judiciaire ne peut lui être octroyée et les frais doivent être mis à sa charge ( art. 5 al. 2 PCF par renvoi de l' art. 71 LTF ; art. 66 al. 1 et 2 LTF );

que l'émolument judiciaire doit être fixé en tenant compte de l'activité déployée jusqu'à ce jour par la Cour de céans ( art. 65 LTF );

que, en l'espèce, le retrait est intervenu alors que le juge instructeur avait terminé son rapport et que l'affaire était prête à être mise en circulation auprès des juges de la Cour;
