Constitutional Appeal Regarding Opposition Lifting Proceedings Dismissed as Inadmissible and Abusive
Legislator-Zusammenfassung
KI-generiertThe case involves a legal dispute regarding the dismissal of a motion filed by an individual against the President of a judicial district in relation to a procedure for lifting an opposition. The judicial decisions in question pertain to constitutional rights and the requirements for such motions as outlined in the relevant legal articles. The higher court ultimately determined that the appeal was manifestly inadmissible, with no indication of constitutional violations presented by the appellant, leading to the recourse being rejected and the judicial costs imposed on the appellant. Additionally, the decision warned against future similar filings from the same individual, suggesting they would not be addressed.

Arrêt du 24 août 2009
IIe Cour de droit civil
Composition
Mme la Juge Hohl, Présidente.
Greffier: M. Fellay.
Parties
X.________,
recourant,
contre
Président 6 e.o. de l'Arrondissement judiciaire I Courtelary-Moutier-La Neuveville, 2740 Moutier,
intimé.
Objet
mainlevée d'opposition,
recours constitutionnel contre le jugement de la
2ème Chambre civile de la Cour d'appel du canton
de Berne du 14 août 2009.
Considérant:
que le jugement attaqué rejette la prise à partie déposée par X.________ à l'encontre du Président d'arrondissement judiciaire intimé dans le cadre d'une procédure de mainlevée d'opposition;
que contrairement aux exigences de l' art. 106 al. 2 LTF (par renvoi de l' art. 117 LTF ), inspirées de l' art. 90 al. 1 let. b OJ ( ATF 133 III 393 consid. 6; 133 IV 286 consid. 1.4), le recourant n'indique nullement en quoi le jugement attaqué violerait ses droits constitutionnels;
que le recours étant ainsi manifestement irrecevable et se révélant de surcroît une nouvelle fois abusif ( art. 42 al. 7 LTF ), il convient, en procédure simplifiée selon l'art. 108 al. 1 let. b et c LTF, de ne pas entrer en matière;
qu'en vertu de l' art. 66 al. 1 LTF , les frais judiciaires doivent être mis à la charge du recourant;
